My spouse and I have our home jointly owned. If we divorce or legally separate, I am thinking of paying the balance owed on the home, ONLY IF my spouse is in agreement that the deed be held in my name only, and he relinquishes any entitlement of the home,the equity, any monies that would result in a future sale and no right to an equity loan  My question is this: would a Judge likely agree to this if my spouse and I agree to it? And could an Attorney have my husband agree to this in writing to cover the legal aspect?
