Company acquisitioned by another company and jobs are being reconstructed.  I have had my position for 8 years. Another position was eliminated by an employee age 29 and was given my title to save her job. My title was changed to Clerk which will soon be eliminated. Since they could not let me go so she could fill my position, due to my age, they are trying to save an age disicrimination suit by giving me another title.  Their thinking is that now when my title is eliminated, they can lay me off and it not be age discrimination.  Do I have and protection under the age laws?

Federal law protects an employee from age based discrimination. If you feel that you are being discriminated against you should file a complaint with your local EEOC office. The EEOC will listen to the facts and investigate. This may require them to contact your employer. However, an employer is not allowed to terminate an employee solely on the basis of the employee having filed a complaint. The EEOC can be reached at (800) 669-4000.
