I recently filed Ch. 7 bankruptcy. I received a court notice that I am being sued for payment of the balance of a credit card that is included in the bankruptcy along with their court costs. Can I be sued by the creditors to pay my debts that are in the bankruptcy? Aren't we suppose to be protected by our bankruptcy?

Once you have been sued, there are strict time limits within which you must file a response. I urge you to contact an attorney immediately. The Mobile Bar Association Lawyer Referral Service may be able to assist you in finding an attorney and they can be reached at 433-1032. With regard to your Chapter 7 bankruptcy, in general, if you have received a discharge from the Court that includes this debt, the creditor should not be able to continue its collection efforts. However, it is important that you file a timely response even if the claim against you does not have merit.
