(GULFPORT, Miss.) A new trial date has been set for an Alabama real estate developer accused of violating the Clean Water Act by illegally filling wetlands near Bay St. Louis, Miss.

William R. Miller, of Fairhope, Ala., was set for trial Feb. 4 on an 11 count indictment.

Attorney Gaines Cleveland, in a written motion, has asked a federal judge to delay the trial to allow time to review "voluminous materials gathered during the investigation."

The Sun Herald reports U.S. District Judge Walter J. Gex III approved his request last week. The trial is now set for April 15.

Miller is accused of polluting waters of the United States by filling federally protected wetlands without approval of the U.S. Army Corps of Engineers.
