AUBURN, Ala. (AP) An attorney for the man accused of poisoning the iconic oak trees at Auburn University's Toomer's Corner has requested an observer evaluate the jury pool for the upcoming case.
The Opelika-Auburn News Tuesday reported that Harvey Updyke Jr.'s attorney Andrew Stanley has requested the evaluation in an effort to support a motion to move the location of the trial.
Updyke's defense attorneys have tried moving the location of the trial several times, saying pre-trial publicity of the case has hindered the court's ability to find an impartial jury.
Pending motions are scheduled to be heard in Lee County Circuit Court Feb. 13 and Updyke's trial is set for April 8.
Auburn University officials say the trees can't be salvaged, and will be removed after the A-Day game April 20.
