USA Police Chief, University Want Lawsuit Dismissed (court documents attached)

MOBILE, Ala. (AP) - The University of South Alabama and its police chief are asking a court to dismiss a lawsuit filed over the shooting death of a naked student on campus.

Both the school and university police chief Zeke Aull claim they can't be sued under state law for the October shooting death of freshman Gil Collar. A university police officer fatally shot 18-year-old Collar in October. The parents of the freshman from Wetumpka filed the suit over the killing last month.

Aull also asks a judge to refuse a demand that he arm all school officers with Tasers. He argues such a move would affect state budgets.

A judge has scheduled a hearing for Feb. 8 in Mobile.

I want to see some truth come out of all of this. I believe every student at USA deserves truth and nothing less. I despise the cop-out of "we can't be sued" because we are the state/county/country/above-the-law. We all know that poor guy was gunned down for no good reason but no one wants to admit their responsibility in this. This whole situation makes me cry.

Typical USA response: "It's not our fault!" It's not our fault that we discriminate in salary increases; it's not fault that our police kill students; it's not our fault that we preside over a crime-ridden campus full of theft, robbery and rape; it's not our fault! it's not our fault! Time for some juries to show that Moulton and the Board are POSs and that it IS their fault!
