Prichard Water Board vs. MAWSS in Court

PRICHARD, Ala. (WPMI) Months after the state voted to turn Prichard's water board over to MAWSS, a judge will now make the decision for them.

This comes after Prichard's water board filed a lawsuit saying the move was unconstitutional. Amendment five received overwhelming support.

A hearing was held Monday. The Mobile Area Water and Sewer Board is trying to get Prichard to turn the system over to them. A judge listened to both sides Monday, saying he was a little concerned that MAWSS could assume Prichard's water board's $50 million in assests.

"I think it is likely to assume that the board will decide if the Circuit Trial Court rules against the water board that they will take it to the Supreme Court," said Prichard Water Board Attorney Jay Ross. "I'm almost certain that will happen."

"Just because you have the right to do something doesn't mean it's morally right to do it!" MAWSS attorney Jim Atchisin shot back. "They're continuing to waste assets of Prichard water when the whole driving force behind this, initially, was Prichard residents came to MAWSS saying, pleas take us over!"

The judge said he would take some time to make a decision, and issue a ruling sometime this week.
