Man to Face Alabama Trial in Wife's Diving Death

BIRMINGHAM, Ala. (AP) - An Alabama man who served prison time in Australia for the death of his bride during their honeymoon is going on trial, accused of murdering her during a scuba dive.

A judge will consider motions and scheduled jury selection to begin Monday in Birmingham for the trial of 34-year-old Gabe Watson.

Watson is accused of killing newlywed bride Tina Thomas Watson. She drowned during the dive in Australia just days after their wedding in October 2003.

Watson already has served 18 months in prison after pleading guilty to manslaughter for not doing enough to save the woman's life.

Alabama prosecutors say Watson planned the honeymoon diving trip so he could kill Tina for insurance money. The defense maintains her death was a horrible accident. The trial could last a month.

Double Jeopardy means that the same sovereign cannot try you twice for the same act or acts. He has never been convicted in the US and he can be tried and convicted for murder and several other crimes like treason that was committed outside the US. He cannot be tried twice for any crime in the US if he was found innocent the first time.

He has already served time in prison in Australia for manslaughter. I don't know all the details of this case, suspect or victim but is sounds like some Alabama money has convinced a judge that in this case "Double Jeopardy" should be allowed. He is being tried twice for the same crime. Once there and now in the U.S. Sorry if you don't like the Australian outcome but that is what the decided he was guilty of there. Something is definitely not right here.
