Hearing Delayed for Alabama Fan

(MOBILE, Ala.) A hearing for an Alabama football fan charged with poisoning Auburn's Toomer's Corner oak trees has been delayed.

A judge postponed Harvey Updyke's competency hearing for December 20.

Updyke's attorney requested the delaying saying Updyke is recovering from a medical procedure and has a doctor's appointment.

Updyke has pleaded not guilty by reason of mental disease or defect. He has already completed a mental evaluation.
