MOBILE, Ala. (WPMI) The state is no longer considering the death penalty for one of the three suspects charged in the murder of a man across the street from the University of South Alabama campus.
Attorneys for Tevin Wells, Christopher Case and Quinten Godfrey were in court Thursday.
All three are charged with murder in the death of Andrew Saxon. Saxon was found shot to death in a driveway across the street from campus January 2012.
Prosecutors say Godfrey pulled the trigger. They say Case allegedly drove the getaway car.
Prosecutors say Godfrey, Case and Wells were stealing electronics from Saxon's home when he was shot and killed.
On Thursday, the state took the death penalty off the table for Godfrey. Wells has requested youthful offender status. That hearing has been scheduled for March 7.
Wells is facing felony murder; Case is charged with felony murder and Godfrey is charged with capital murder. All three suspects have pleaded not guilty.
