(MOBILE, Ala.) (AP) April 4 - A former Elberta man charged with manslaughter in his 3-year-old daughter's drowning in 2003 has been arrested at his mother's home in North Carolina.

The Baldwin County Sheriff's Office said police and U.S. marshals arrested 35-year-old Jason Woerner in Charlotte on Wednesday. It was not clear Friday if Woerner had a lawyer.

Authorities said Woerner, whose trial is now set for May, has failed to show up for trial previously in the death of his daughter, Breanna Lynn Woerner. He and his wife were accused of failing to provide proper care and supervision when the 3-year-old drowned at Pirates Cove Marina on the night of July 18th, 2003.

His wife, 29-year-old Stephanie Woerner of Elberta, has pleaded guilty to criminally negligent homicide.
