Prichard Police Chief: Mayor Has No Authority to Terminate

(MOBILE, Ala.) - A circuit court judge will decide whether or not to enforce a temporary restraining order filed by the City of Prichard against its police chief.

Prichard Mayor Troy Ephriam and Police Chief Jimmy Gardner appeared in court Friday at Government Plaza for a hearing regarding the temporary restraining order filed Thursday, the same day Ephriam had delivered a letter of termination to Gardner.

Chief Gardner has since argued that the mayor does not have the legal authority to fire him, and refused to vacate his office. Gardner appeared at Friday's hearing in full uniform.

Circuit Court Judge Joseph Johnston said his decision on the restraining order could come as late as Monday.

As of Friday evening, it is up to perception as to who is running the Prichard Police Department.

"Captain Arthur Farrow will serve in that capacity," Mayor Ephriam said.

Ephriam said he was working within the framework of the law in serving Chief Gardner with a termination notice after his contract expired on November 20th.

"We stand by that, and we feel affirmed that the judge's decision will be in our favor," Ephriam said.

Prichard City Attorney Jerome Carter argued in court Friday that Alabama law (ALA. Code Section 11-43C-38) required four city council votes to approve the police chief's five-year contract in October, and the chief only got three.

Former Prichard Mayor Ron Davis and Chief Gardner's attorney interpret the same law differently.

"I guess the mayor is looking for a yes man, and Chief Gardner wouldn't be the one to do that," Davis said. "It takes four council members to fire the chief. The mayor does not have the sole authority to fire the chief."

Whatever Judge Johnston decides, Davis hinted the battle between the mayor and the police chief is more than just about contracts.

"I'm quite sure that there's some things that may come out later on," Davis said. "I'm not at liberty to talk about those things."

Local 15 News posed the question of underlying circumstances to the chief's termination to Mayor Troy Ephriam.

"It remains to be determined. Yes," Ephriam said.

Being that Prichard is as poor as it is, why haven't they kicked restoration youth academy out of that facility? The organization owes well over $45,000 in rent alone. They have no lease to be there so they're actually squatters who are laundering money and abusing children. As a former instructor I've witnessed all this with me own eyes. John Young bragged about being good friends with the former mayor and former chief of police. And between the two of them they have overturned the city counsels decision to make them leave.. They're only bringing bad publicity to the city of Prichard and there not helping the kids nor community by committing fraud and abuse, be it mental, verbal, emotional, and worse physical abuse. The kids are afraid to admit how things really are because they know if they say one wrong word they're going to be beaten.

Read between the lines people!!! This is all about politics and retaliation on Ephriam's part, undoubtedly Chief Gardner supported former Mayor Ron Davis, Ephriam's opponent in the election and Troy's first order of business is to fire Gardner no matter how well a Chief he is and has been. Real petty and political on Ephriam's part to put revenge and politics above the safety and security of the city of Prichard. A good Mayor would try to unite and bring the people together and move on, yet Troy's agenda is to clean house of people that wasn't on his side in the election. Chief Gardner hasn't been the best Chief of Police in Prichard but he is the best one to come along in recent memory. Former Chief Lawrence Baptiste was simply a figure head and yes man but Gardner seems to be a real man of the people and cop smart that has the expertise and courage to change things. Ephriam alreay seems to be much like Mobile Mayor Scam Jones, put in place a lame Chief and stooge that will simply agree to anything that Sam says and does. Look for Jimmie Gardner to run for Mayor in the next election and unseat Ephriam and he can fill the position with his own Chief of Police and Ephriam will suffer the fate he certainly deserves.

What a moron I am sorry I voted for Ephraim. Police Chief Gardner is a good law enforcement officer. I remember when he single handedly brought down a would be robber at the Advance Auto Parts store near Saraland. He is always on top of the situation and does his best for the citizens. What kind of message is this sending to the criminal element in the city?

I guess when you are a city that depends on the federal government and welfare to exist, you have to have something to occupy your time. Prichard has massive problems and these morons are fighting over idiocy. Prichard is Pathetic, and somehow they expect people to accept their absolute thuggery in the running of what is now a purely illegal water department? The entirety of the elected members of Prichard government need jail time!
