(AUBURN, Ala.) - The Alabama fan accused of poisoning the Toomer's Corner oak trees has been released.

Harvey Updyke has completed a mental examination at a secure medical facility in Tuscaloosa to determine if he is competent to stand trial.

Updyke has pleaded not guilty by reason of mental disease or defect to charges that include criminal mischief and desecrating a venerable object.

His competency hearing is December 10th.
