If you are driving drunk and cause the death of another, under law you can be charged with murder. There is no reason whatsoever the same should not apply for texting. When a person texts and drives, they are making a conscious decision to endanger and threaten the lives of all in their path. I hope it is not the case in this accident. But if it is, substantial jail time and permanent loss of driving privileges should at least be a minimum sentence.
