There are many criminal and civil laws that prohibit and protect against domestic violence. But when those laws fail, a person may become the victim of physical violence. In most states, the victim is entitled to seek compensation for injuries sustained by the violence in the form of money damages against the perpetrator. While some states still provide immunity from such suits between spouses, most have abolished this ancient doctrine of law and permit a lawsuit by an injured spouse against the other individual for assault and battery. In certain cases, a female victim may also be able to seek compensation under the federal Violence Against Women Act of 1994. If you or a person you know has been injured as a result of domestic violence, consult an attorney to learn more about how the law may provide compensation for those injuries.
